(a) A parent or other household member who is responsible for the care of a dependent child under six years of age, or an incapacitated person, shall be exempt from the work registration requirement. The exemption shall apply even if the child or incapacitated person:
(1) Is not a household
member for food stamp purposes; or
(2) Does not live with the food stamp
household.
(b) If a parent and another member of the household both claim to be responsible for the care of the same dependent child or incapacitated adult, the actual responsibility as caretaker shall be determined by the department from a discussion with the household members.
