Section 17-680-22 - Determining eligibility prospectively

(a) Eligibility for food stamp benefits shall be prospectively determined based on the branch's best estimate of the household composition, countable assets, income, and other eligibility factors which will exist in the payment month.

(b) With the exception of categorically eligible households as specified in section 17-663-143, the household shall be ineligible for food stamp benefits in any payment month the department determines that the household's income exceeds the household's gross or net income limit, asset retention limit, or when the household fails to meet other eligibility factors, except when the household is suspended under section 17-680-29.
