Section 17-663-30 - Treatment program penalties and disqualifications

(a) The drug addiction or alcohol treatment and rehabilitation program which is authorized by FNS as a retail food store may be penalized or disqualified by FNS if it is determined administratively or judicially that food stamp benefits were misappropriated or used for purchases that did not contribute to a certified household's meals. When the branch, has reason to believe that a treatment program is mishandling food stamp benefits in a household's EBT account, the branch shall promptly notify the department's Benefit, Employment and Support Services Division so that FNS may be notified.

(b) The branch shall not take any action against the treatment program prior to FNS action.
