Section 17-655-47 - Verification of citizenship

(a) The department shall request verification of citizenship when an applicant or recipient's statement is questionable. Acceptable forms of verification include, but shall not be limited to:
(1) Birth
certificate;
(2) Religious
records;
(3) Certificates of
citizenship or naturalization provided by the INS, including:
(A) Identification card for use of resident
citizens of the United States (INS forms 1-179 or 1-197); or
(B) United States passport;
(4) Participation in either a
financial or food stamp program; or
(5) A signed statement from a United States
citizen, who declares, under penalty of false swearing, that the applicant or
recipient in question is a United States citizen:
(A) The family shall provide a
reasonableexplanation as to why verification is not available; and
(B) The signed statement shall include a
warning of the penalties for making false statements.
(b) Assistance to the family shall not be delayed for lack of verification of citizenship of an individual if the rest of the family meets all other eligibility criteria provided:
(1) The applicant or recipient whose
citizenship is in question shall be ineligible; and
(2) Until proof of United States citizenship
is obtained, that member's income and assets shall be considered available to
the remaining family members for the financial and food stamp
programs.
