Section 17-655-30 - Food stamp eligibility requirements for residents of institutions

(a) Residents of institutions shall not be eligible for participation in the food stamp program, except for:

(1) Residents of federally subsidized housing for the elderly, built under either section 202 of the Housing Act of 1959 ( 12 U.S.C. §1701 q) or section 236 of the National Housing Act ( 42 U.S.C. §3538);

(2) Narcotic addicts or alcoholics who, for the purposes of regular participation in a drug addiction or alcohol treatment and rehabilitation program, reside at a facility or treatment center;

(3) Disabled or blind individuals who are residents of group living arrangements and who receive benefits under title II or title XVI of the Social Security Act ( 42 U.S.C. §§401 - 433, 1381 - 1383 );

(4) Women and children residing in shelters for battered women and children; and

(5) Residents of public or private nonprofit shelters for homeless persons.

(b) Residents of public institutions who apply for SSI prior to their release from an institution under the Social Security Administration's Prerelease Program for the Institutionalized ( 42 U.S.C. §1383(j)) shall be permitted to apply for food stamps at the same time the residents apply for SSI. These prerelease applicants shall be processed according to the food stamp application requirements.
