Section 17-653-17 - Assignment of rights to support

(a) All individuals shall assign to the state any rights the individuals may have to receive child, spousal, or medical support and any other third party payments on the individual's own behalf or on behalf of any other family member applying for or receiving assistance, and any support payments which may have accrued at the time the assignment is executed.

(b) Assignment of rights to payments shall not include assignment of rights to medicare benefits.

(c) An applicant or recipient shall inform the department of an involvement in an accident within thirty days of the accident.

(d) The department shall deny or terminate financial assistance to the entire household of an individual who refuses to assign the individual's own rights or the rights of any other family member who is receiving assistance or for any person for whom the individual has applied or is receiving assistance.

(e) The department shall deny or terminate medical assistance to an individual who refuses to assign the individual's own rights or the rights of any other family member for whom the individual can legally make an assignment.
