Section 17-600-3 - Definitions

For the purpose of this subtitle unless the context otherwise indicates:

"Aid to families with dependent children (AFDC)" means the financial assistance program administered by the DHS-FASD under Title IV-A of the Social Security Act ( 42 U.S.C. §§601 - 610 ).

"Applicant" means an individual applying for or requesting social services, financial assistance or food stamps.

"Branch" means any one of the four work units within the family and adult services division which administers the social services, financial assistance and food stamp programs in the counties of Kauai, Oahu, Maui, and Hawaii.

"Code of Federal Regulations (CFR)" means the annual cumulation of executive agency regulations published in the daily Federal Register, combined with regulations issued previously that are still in effect. The CFR contains the general body of regulatory laws governing practice and procedure before federal administrative agencies.

"Department (DHS)" means the department of human services.

"Director" means the administrative head of the department of human services unless otherwise specifically noted.

"Eligibility worker (EW), payment worker, or income maintenance worker (IMW)" means an employee of DHS-FASD responsible to process the determination of financial assistance, medicaid, or food stamps.

"Family and adult services division (FASD)" means the work unit within the department which administers the social services, financial assistance and food stamp programs.

"Family and adult services division administrator (FASDA)" means the administrative head of the family and adult service division of the department of human services.

"Federal register (Fed. Reg.)" means the daily publication for making available to the public federal agency regulations and other legal documents of the executive branch including proposed changes. The regulations and rules as finally approved appear thereafter in the CFR.

"Financial assistance" means public assistance excluding medical assistance, social services, and transportation assistance.

"Food stamp program" means the program administered by the DHS-FASD under the Food Stamp Act of 1977, ( 7 U.S.C. §§2011 - 2027 ) as amended, to provide food stamps to persons found eligible under the eligibility requirements.

"HIV/AIDS" means human immunodeficiency virus/acquired immunodeficiency syndrome, a fatal infectious disease caused by the human immunodeficiency virus that damages the body's immune system and leads to the body's inability to fight off infections.

"In camera review" means the review of records privately in a judge's chambers or in a courtroom void of all spectators before the judge makes a determination of the admissibility or use of these records in the proceedings.

"General assistance (GA)" means the financial assistance program administered by the DHS-FASD under § 346-71, HRS.

"Hawaii revised statutes (HRS)" means the official codification of all the laws of a general and permanent nature of the state of Hawaii.

"Income maintenance" means the combined programs of financial assistance and food stamps.

"Public assistance (PA)" means social services rendered and financial, and medical assistance paid to or for individuals whom the family and adult services division determines meet eligibility requirements specified in subtitle 6 and subtitle 9 of title 17.

"Recipient or client" means any person to whom a service is rendered or a grant of social services or financial assistance is made by direct payment, and any person for whose use and benefit a service is rendered or a grant of social services or financial assistance is made by payment to a relative or other person.

"Section" means a collection of units within a branch with responsibilities in specific public welfare programs areas such as income maintenance or social services.

"Social services" means crisis intervention, counseling, case management, and support activities such as day care and chore services provided by the department staff, by purchase of service, or by cooperative agreement with other agencies to persons meeting specified eligibility requirements. Social services provided by the DHS-FASD shall be administered under Titles IV-B ( 42 U.S.C. §§620 - 629) , IV-C ( 42 U.S.C. §§630 - 644), IV-E ( 42 U.S.C. §671) , and XX ( 42 U.S.C. §1397) of the Social Security Act, as amended and chapters 346 and 363, HRS.

"State AABD" means state-funded financial assistance program administered by the department of human services for aged, blind and disabled individuals.

"Supplemental security income (SSI)" means the financial assistance program of aid, based on need, to the aged, blind, and disabled, administered by the federal Social Security Administration under Title XVI of the Social Security Act ( 42 U.S.C. §§1381 - 1383 ).

"Unit" means the work unit within a section or branch which administers the social services, financial assistance or food stamp program.

"United States code (U.S.C.)" means the official codification of all the laws of a general and permanent nature of the United States. Every six years a new edition of the U.S.C. is published with cumulative supplement volumes issued during the intervening years.

"Vendor" means a third party who receives payment directly from the department in return for services or goods rendered on behalf of the recipient.
