Section 17-2-13 - Subpoenas

(a) Upon timely written request, the director or hearing officer may issue subpoenas requiring attendance of witnesses or production of documents at a hearing. The director or hearing officer may require that a request to issue a subpoena specify the person to be subpoenaed or the documents desired. Witnesses summoned shall receive the same fees and mileage reimbursement as witnesses in state courts, to be paid by the department.

(b) Upon timely motion, the director or hearing officer may:

(1) Quash or modify the subpoena if it is unreasonable and oppressive; or

(2) Condition denial of the motion upon the requesting party's payment of the costs of producing the subpoenaed documents.
