Section 17-1736-75 - Reopenings for hospital and institutional providers

(a) A hearing officer may reopen a decision at any time within three years after the date of the decision.

(b) Notice shall be given to all parties of the hearing officer's intent to reopen and the reasons therefore.

(c) The decision to reopen, or not to reopen rests solely with the hearing officer and shall not be subject to appeal.

(d) The three years time limit shall be waived if the reopening is due to evidence of fraud.
