(a) The department may issue a provisional certificate of approval for ninety calendar days when an agency:
(1) Is unable to comply with all
the requirements for licensure because of circumstances beyond its control and
the areas of non-compliance:
(A) Do not pose
a risk to the health, safety, or well being of children; and
(B) Are expected to be corrected within
ninety calendar days from the date the department notified the agency;
or
(2) Has an
application that was not disposed of by the ninetieth day of the receipt of the
application, documents, and verifications required in section
17-1627-7(b).
(b) The provisional certificate of approval may be renewable for periods no longer than ninety calendar days until the agency meets all requirements or until the department makes a final disposition on the application.
