Section 17-1620-11 - Eligibility requirements for interjurisdictional adoptions

(a) For inter-jurisdictional adoptions, if the department does not have responsibility for placement and care of the child, the adoptive parent(s) shall apply for adoption assistance in the adoptive parent(s) state of residence.

(b) For inter-jurisdictional adoptions where there is no signed agreement for adoption assistance, the state in which the final adoption decree is issued is responsible for reimbursement of nonrecurring adoption expenses if the child meets the eligibility requirements of that state.
