(a) The legal custodian and the recipient of child welfare services have a right to a hearing pursuant to chapter 17-1602 if dissatisfied with any adverse action taken by the department.

(b) Perpetrators or maltreaters have a right to a hearing pursuant to chapter 17-1602 and departmental procedures if dissatisfied with the disposition of the department's assessment or action taken by the department as a result of a report of abuse or neglect.

(c) Subsections (a) and (b) shall not apply and the department shall refer the legal custodian, recipient, or perpetrator to the family court for any matter falling under the provisions of chapter 587A, HRS, that has been heard in family court where a finding and/or ruling has been made or is pending before the family court judge.
