Chapter 1424 - LICENSING OF ADULT DAY CARE CENTERS
Section 17-1424-4.1 - Disposition of application

(a) The department shall dispose of an application for a certificate of approval no later then sixty days from the date of application.
(b) The department shall dispose of an application by taking one of the following actions:
(1) An applicant shall be determined eligible
for a certificate of approval when it is clearly established and recorded that
the applicant meets all the standards for the issuance of a certificate of
approval to operate an adult day care center; or
(2) An applicant shall be determined
ineligible for a certificate of approval when it is clearly established and
recorded that the applicant does not meet the standards for the operation of an
adult day care center.
(c) When the department does not dispose of an application by the sixtieth day from the date of application, the applicant shall be issued a temporary certificate of approval as provided in section 17-1424-5(b). The issuance of this temporary certificate of approval does not constitute a final disposition. The application shall be processed and a disposition shall be made as soon as possible.
