Section 16-96-3 - Pilotage rates and charges

(a) All rates, charges, policies, procedures, and practices that are made, charged, or observed by a licensed pilot shall be filed with the director in such form and manner as the director may require, and copies shall be furnished by the pilot to any person upon request. Copies of the rates, charges, rules, and practices shall also be made available at the department.

(b) No rate, charge, rule, or practice shall be made, charged, or observed by any licensed pilot except after a duly noticed public hearing and contested hearing held pursuant to chapter 91, HRS, and as further provided in subchapter 3 of this chapter. Except to the extent that the director finds that unfairness would result, the director shall establish uniform rates and charges.

(c) All rates, charges, rules, and practices that were in effect prior to the effective date of this chapter shall remain in effect until otherwise ordered by the director pursuant to this section.
