(a) Except as otherwise provided in this section, any written advertising, recording, or radio or television announcements, broadcast or commercial to be used in connection with the sale of securities in Hawaii shall be filed with the commissioner at least two days prior to its proposed use.

(b) The following materials are exempt from the filing requirements of this rule: all advertising material previously filed with and cleared by the SEC or NASD; all "tombstone" advertisements; and all advertisements relating to a federal covered security or to a security that is exempt from registration pursuant to section 485-4, HRS, (exempt securities) or section 485-6, HRS, (exempt transactions).
