Section 16-133-42 - Public notice of filings for initial rates and proposed rate increases

(a) Upon receipt from a cable operator of a filing for an initial rate schedule or proposed rate increase for the basic service tier and the associated equipment, the director shall provide public notice of the filing and shall afford all interested persons an opportunity to submit comments, data, views, or arguments, in writing. Public notice of a filing shall be published at least once in each of two successive weeks in a newspaper of general circulation in the county in which the cable operator provides service. The first published notice shall appear at least fifteen days prior to the date the proposed existing or proposed increases in rates become effective.

(b) The director may hold a public hearing on the filing to afford interested persons the opportunity to provide oral testimony in addition to written comments, data, views, or arguments. Notice of the public hearing shall be published at least once in each of two successive weeks in a newspaper of general circulation in the county in which the cable operator provides service. The first published notice shall appear at least fifteen days prior to the date of the public hearing.
