Section 16-133-27 - Initiating the renewal process: ascertainment proceeding

(a) Upon receipt of the cable operator's written notice of intent to apply, or upon the director's own initiative, renewal procedures shall commence during the six-month period which begins with the thirty-sixth month before the franchise expiration.
(b) The director shall begin by conducting a proceeding which affords the public in the franchise area appropriate notice and participation to:
(1)
Identify future cable-related community needs and interests; and
(2) Review the performance of the cable
operator under the currently existing franchise term.
(c) This proceeding may include subscriber and institutional surveys, requests for written comments, or any other activities which the director believes are necessary to identify future cable-related needs and interests and to review the past performance of a cable franchise.
