Section 14-52-53 - Appealing a denied or partially paid claim

(a) Within sixty days after a participant receives notice denying a claim in whole or in part under section 14-52-52, the participant or the participant's duly authorized representative may request in writing a full and fair review of the claim by the director,

(b) The director may extend the sixty-day period where the nature of the benefit involved or other attendant circumstances make the extension appropriate,

(c) The appeal shall include all pertinent information related to the claim and shall be submitted to the director, who shall make the final decision.

(d) The director shall render a final decision within sixty days after receipt of the appeal; provided that if special circumstances require an extension of time, the director shall render a final decision within one hundred twenty days after receipt of the appeal. The director's decision shall be in writing and shall include specific reasons for the decision,

(e) Except as otherwise provided by law, all decisions on appeals by the director shall be final and conclusive upon all participants.
