Section 13-169-34 - Notice; public hearing

(a) Upon the drafting of a proposed instream flow standard and prior to its adoption, the commission shall hold a public hearing and shall publish a notice of the hearing, setting forth the:

(1) Affected stream(s) or stream reach(es) thereof;

(2) Purpose of the public hearing; and

(3) Time, date, and place of the public hearing where written or oral testimony may be submitted or heard.

(b) The notice shall be published at least once in a newspaper of statewide circulation and the last publication shall be not less than twenty days before the date set for the hearing.
