Section 12-47-40 - Order of presentation

(a) In all hearings before the board, the appellant, complainant, or movant shall open and close, unless the presiding member directs otherwise. Appellees, interveners, and respondents shall be heard in the order the presiding member directs.

(b) The order of presentation shall not alter the burden of proof, including the burden of producing evidence and the burden of persuasion. The party or parties who must bear these burdens shall be determined by law.
