Section 12-46-24 - Substitution of parties

Upon motion and for good cause shown, substitution of parties may be ordered provided that the substitution shall:

(1) Be conducive to effectuating the ends of justice;

(2) Not unduly delay the proceeding; and

(3) Not otherwise unduly harass, hinder, or prejudice the rights of any party.

Except that in the case of the death or legal incapacity of any party, substitution may be ordered without the necessity of filing a motion therefor.
