Section 12-43-42 - Ex parte communications

(a) No employee, public employee, exclusive representative, employer, public employer, or any other person or organization, whether or not a party to a proceeding before the board, shall engage in any unauthorized ex parte communications, either orally, in writing or electronically, about any proceeding or matter pending before the board with any member of the board.

(b) The following classes of communications shall not be prohibited:

(1) Those which relate solely to matters which a board member or hearings officer is authorized to dispose of on an ex parte basis;

(2) Requests for information with respect to the status or scheduling of a proceeding;

(3) Those which all parties to the proceeding agree, or which the board has formally ruled, may be made on an ex parte basis; and

(4) Those with representatives of any news media on matters intended to inform the general public.
