Section 12-41-36 - Decision and order

(a) In the event no statement of exceptions is filed as provided in this chapter, the findings, conclusions, and recommendations of the hearings officer or any member of the board conducting the hearing as contained in the report and recommended order shall be adopted by the board and become its findings, conclusions, and order, and all objections and exceptions thereto shall be deemed waived for all purposes. However, the board may order the case closed upon compliance.

(b) Upon the filing of a statement, of exceptions and briefs, the board may:

(1) Decide the matter forthwith upon the record, or after oral argument;

(2) Reopen the record and receive further evidence;

(3) Close the case upon compliance with recommendations of the report; or

(4) Make other disposition of the case.
