Section 12-27-29 - Demand and order

(a) If the department finds that informal methods in section 12-27-27 will not resolve the complaint, the department shall issue an order and a demand for compliance by certified mail, return receipt requested, or personal delivery.
(b) The demand and order shall require the employer to:
(1) Cease and desist from
engaging in the alleged unlawful practice; and
(2) Take appropriate remedial
action.
(c) Within twenty days after the date of the demand and order, the employer may either:
(1) Notify the department of the employer's
decision to comply by signing and returning the demand and order; or
(2) File a written appeal in accordance with
section 12-27-32.
(d) If an employer fails to take any action as provided in subsection (c), the department or the complainant may initiate civil action pursuant to Section 398-25, HRS.
