(a) A dispensary shall establish a written recall plan for cannabis and for each manufactured cannabis product.
(b) The written recall plan shall include procedures that describe the steps to be taken, and assign responsibility for taking those steps, to perform the following actions as appropriate to the dispensary:
(1) Notify the retail dispensing
locations of the product being recalled, including how to return or dispose of
the affected product;
(2) Notify
qualifying patients, qualifying out-of-state patients, and the public about any
hazard presented by the product when appropriate to protect public
health;
(3) Conduct effectiveness
checks to verify that the recall is carried out; and
(4) Appropriately dispose of recalled product
(e.g., through reprocessing or destroying the product).
(c) A dispensary shall notify the department in writing within twenty-four hours of initiating a recall.
