(a) This subchapter incorporates by reference, provisions of 40 CFR Section 52.21, Prevention of Significant Deterioration of Air Quality, as it existed on May 1, 2023 and applies to owners or operators planning to construct a major stationary source or to make a major modification to such a stationary source. Provisions of 40 CFR Section 52.21 are additional requirements for considering an application for a covered source permit required by subchapter 5.

(b) No stationary source or modification to which the requirements of this subchapter apply shall begin actual construction without a covered source permit which states that the stationary source or modification would meet the requirements of 40 CFR Section 52.21.
