Section 11-504-9 - Suspension, revocation, or modification of certification

The director may suspend, revoke, or modify any certification issued under these rules if, after according the certificate holder an opportunity for a hearing in accordance with chapter 91, HRS, the director determines that the person has not complied with applicable procedures and standards or for any reason given in section 11-504-8. At a minimum, the standards shall include:

(1) The person has failed to meet the standards set forth in this chapter;

(2) The person has performed work requiring certification at a job site without being in physical possession of a copy of his or her current certificate;

(3) The person has provided his or her own certificate or permitted the duplication of it for use by another;

(4) The person has performed work for which certification has not been received;

(5) The person has obtained certification from a training provider that is not accredited to offer training for the particular discipline; or

(6) The person has violated other asbestos regulations administered by the State.
