Chapter 502 - ASBESTOS CONTAINING MATERIALS IN SCHOOLS
Section 11-502-1 - Scope and purpose

(a) This chapter requires the local education agencies to identify friable and nonfriable asbestos-containing material in public and private elementary and secondary schools by visually inspecting school buildings for such materials, sampling such materials if they are not assumed to be asbestos-containing material, and having samples analyzed by appropriate techniques referred to in this chapter. This chapter also includes record keeping requirements, including the development of an asbestos management plan. This chapter requires the use of persons who have been certified to conduct inspections, reinspections, develop management plans, or perform response actions as required in chapter 11-504. Local education agencies may contractually delegate duties mandated pursuant to this chapter, but each remains responsible for the proper performance of those duties. The local education agencies are encouraged to consult with EPA Regional Asbestos Coordinators or the department of health for assistance in complying with these rules.

(b) Local education agencies shall provide for the transportation and disposal of asbestos in accordance with 40 CFR Part 763, subpart E, appendix D, entitled "Transport and Disposal of Asbestos Waste." There are federal regulations in place, however, that affect transportation and disposal of asbestos waste generated through compliance with these rules. The transportation of asbestos waste is covered by the department of transportation ( 49 CFR Part 173, subpart J), and disposal is covered by state asbestos requirements in accordance with chapter 11-501
