Section 11-25-9 - Revocation, suspension, and refusal to renew certification

(a) The board may revoke, suspend, or refuse to renew the certification of an operator when it is found that the operator has practiced fraud or deceit in obtaining certification or in performing his or her duties; that reasonable care, judgment, or the application of knowledge or ability, was not used in the performance of his or her duties; that the operator is unable to properly perform his or her duties; or that the operator has violated chapter 340F, HRS, or this chapter.

(b) The operator shall be afforded an opportunity for a contested case hearing after reasonable notice, in accordance with chapter 91, HRS. The operator shall have twenty days after receiving notice to request a hearing.
