Section 11-23-07 - Prohibition

(a) Without exception, any injection well not defined by class V in section 11-23-06 shall not be permitted to be constructed, operated or to exist in the State. Class V injection wells shall be permitted to be constructed, modified and operated to the extent provided by, and subject to, the reguirements of this chapter.

(b) No new subclass A well shall be constructed or operated in an Underground source of drinking water after July 6, 1984.

(c) No injection well owner or Operator shall construct, operate, maintain, or close its injection well unless authorized by this chapter, a permit, or an order to do so.

(d) No injection well owner or Operator shall violate any term of any written authorization, including those relating to inspection, monitoring, recordkeeping, and reporting.
