Section 11-106-5 - Frequency of background checks

(a) Operators, employees or contractors subject to the requirements of this chapter shall obtain a background check within five working days of operation or hire for the purposes of complying with the requirements of this chapter.

(b) Healthcare providers shall make a name inquiry into the state's criminal history records on employees or contractors for each of the first two years of employment or contract and biennially thereafter to ensure continued compliance with background check standards.

(c) The department may waive the requirements of paragraph (b) of this section for employees, contractors, or healthcare providers or operators enrolled in the state's rap back program.
