Rule 80-14-5-.05 - Debt Collection

(1) In addition to the requirements of O.C.G.A. § 7-3-33, each non-employee debt collector utilized by a licensee must comply with the requirements of the Fair Debt Collection Practices Act ("FDCPA"), 18 U.S.C. 1692 et seq.

(2) Every licensee shall be presumed to know that any employee or agent of the licensee, which includes non-employee debt collectors utilized by the licensee, will be acting for and on behalf of the licensee in connection with the collection of any debt allegedly owed the licensee. Every licensee shall be responsible for compliance with O.C.G.A. § 7-3-33by the employee or agent in collecting or attempting to collect any debt allegedly owed to the licensee.
