Rule 80-11-1-.09 - Electronic Service of Notice of Intent to Deny, Revoke, or Suspend License or Registration

Any notice served by the Department pursuant to O.C.G.A. § 7-1-1017shall first be sent by email to the email address of record that the applicant, licensee, or registrant has designated as their email address for regulatory contact on file with the Nationwide Multistate Licensing System and Registry. Any notice sent by email shall be deemed delivered once the Department receives a non-automated affirmative response from the intended recipient of such notice and no further service will be thereafter attempted by the Department in relation to that notice. If the Department does not receive an affirmative response from the intended recipient within five business days of emailing the notice to the email address of record, the Department shall then attempt to deliver the notice via registered or certified mail or statutory overnight delivery to the principal place of business of such applicant, licensee, or registrant. In the event the above methods of service are unsuccessful, the Department may attempt to deliver the notice under any other method of lawful service.
