Rule 590-3-1-.13 - Sales Contracts

(1) Each contract for sale of burial rights, burial or funeral merchandise, or burial or funeral services shall contain details and information prescribed in O.C.G.A. § 10-14-18. The signature page of the contract shall include:
IF YOU HAVE ANY COMPLAINTS ABOUT THIS CONTRACT OR THIS TRANSACTION OR HAVE QUESTIONS ABOUT THE LAW GOVERNING THIS TRANSACTION, YOU MAY CONTACT THE OFFICE OF THE GEORGIA SECRETARY OF STATE AT (404) 656-3920.
(2) Any form of contract complying with any applicable federal law or regulation relating to the identical subject matter of information and required items of disclosure described herein shall be deemed in compliance with this rule to that extent. Any disclosure required by the present rule that is not contained in any contract whose contents are governed by such applicable federal law or regulation may be made by separate document displayed to and acknowledged by the customer at the time of purchase.
(3) The Secretary of State may, upon request by the registrant, approve the use of other forms of contracts, the form of which are in substantial conformity with the requirements of this rule.
