Rule 391-3-2-.03 - Permit Required

(1) No person shall after December 1, 1974, withdraw, obtain or utilize ground water in excess of one hundred thousand (100,000) gallons per day for any purpose unless such person has first obtained a permit therefor from the Division, unless exempted by law or these Regulations. For farm use, no person shall after July 1, 1991 withdraw, obtain, or utilize ground water in excess of 100,000 gallons per day on a monthly average unless such person has obtained a permit from the Division. (2) Pending the issuance or denial of a permit, any person who has applied for a ground water use permit and who was withdrawing or using ground water prior to April 18, 1973 (or July 1, 1988 in the case of farm use), may continue the same use which existed prior to that date.
(3) Any combination of farm and non-farm use, or nonconsumptive ground water use, shall be considered a non-farm ground water use, unless the Director determines that the predominant use to which the water is put is farm use.
