Rule 300-3-19-.04 - Contractors

(1) It is the responsibility of any independent contractor who performs work for any public employer or on any State property to ensure that its employees and its subcontractors are provided with information and training on hazardous chemicals being used by the independent contractor or its subcontractors in the workplace. Documentation that such information and training has been provided shall be furnished to the workplace manager.

(2) The workplace manager at the site or property at which an independent contractor or its subcontractors are performing work shall be notified at least (30) thirty days prior to the commencement of work of any hazardous chemicals which will be used or stored in the workplace by the independent contractor or its subcontractors. However, this (30) thirty day advance notification requirement may be waived in the event of an emergency. The waiver of said advance notification requirement does not relieve the independent contractor or its subcontractors from notifying the workplace manager of any hazardous chemicals which will be used in the performance of emergency work prior to the commencement of the work or providing documentation, upon request of the workplace manager, that its employees or subcontractors have been provided with information and training on the hazardous chemicals being used or stored in the workplace.

(3) Independent contractors or subcontractors may not commence work if the contractor or its subcontractors have not complied with paragraphs (1) and (2) above. Any such delay shall not result in any penalty to the public employer.
