Section 69L-30.005 - Selection of Expert Medical Advisors

(1) All individuals on the Certification List are eligible to provide EMA services for the Department or a JCC.

(2) When services are needed by the Department, the Department shall:

(a) Select an EMA from the Certification List; and,

(b) Make the necessary arrangements for the EMA to provide the services.

(3) When services are needed in a proceeding before a JCC, the JCC shall:

(a) Select an EMA from the Certification List; and,

(b) Make the necessary arrangements for the EMA to provide services.

(4) Upon receiving notice of selection by the Department or JCC, the EMA shall disclose any conflict of interest related to the case and shall decline selection if a conflict of interest, pursuant to rule 69L-30.007, F.A.C., exists.

(5) A physician who has been disciplined for a violation pursuant to section 440.13, F.S., and/or rule 69L-30.010, F.A.C., or who, pursuant to a final order, has been found to have violated chapter 440, F.S., shall not be certified as an EMA.
