Section 64B3-1.015 - Probable Cause Determinations

(1) The determination as to whether probable cause exists that a violation of the provisions of Chapters 456 and 483, Part I, F.S., and the rules promulgated thereto has occurred shall be made by a majority vote of a probable cause panel of the Board.

(2) There shall be one probable cause panel of the Board, which shall meet the requirements set forth in Section 456.073, F.S. The probable cause panel shall be composed of two members, one of whom may be a past Board member.

(3) The probable cause panel members shall be selected by the Chair of the Board, one of whom shall be designated by the Chair of the Board as the presiding officer of the panel.

(4) The probable cause panel shall meet at such times as called by the presiding officer of the panel or by two members of the panel.
