Chapter 61G2-5 - STANDARDS OF PRACTICE
Section 61G2-5.002 - Required Record Keeping

(1) The auction business which conducts an auction must maintain for a period of 2 years from each sale, a record book of all sales for which a written agreement is required. This record book is subject to inspection by the Department or at the request of the Board and must contain the following:

(a) A brief description of the property offered;

(b) The name and address of the owner of the property offered;

(c) The name and address of the buyer;

(d) The price at which the property sold;

(e) The date sale proceeds were delivered to the owner; and

(f) The date and place of sale.

(2) Clerking records shall be maintained to supply the information required in paragraphs 61G2-5.002(1)(a), (c) and (d), F.A.C., so long as they are maintained in a manner which is readily available and accessible to the Board and Department.

(3) Record Keeping: Inspection of the records of the auction business shall be required in connection with any violation of Chapters 455 and 468 part VI, F.S., or any rules promulgated thereunder.
