Section 53ER02-26 - Designation of Hearing Officer in Bid Protest

If a bid protest filed in a Lottery procurement is not resolved by mutual agreement within seven days, excluding Saturdays, Sundays, and legal holidays, and if there is no disputed issue of material fact, the Secretary shall designate a Hearing Officer who shall conduct an informal proceeding pursuant to Section 120.57(2), Florida Statutes, and Chapter 28, Parts I and III, F.A.C. The qualifications of such Hearing Officer shall be:

(1) A member in good standing of the Florida Bar; or

(2) A person knowledgeable by virtue of practical experience of the procedures relating to soliciting and evaluating bids for commodities or proposals for services; or

(3) A person knowledgeable by virtue of practical experience or training of the procedures relating to legal or other administrative proceedings in which decisions are rendered.
