9.1 Hearing
9.1.1 The Secretary, or the Secretary's
authorized designee, shall hold a public hearing on any changes to the
Regulations that he shall propose for adoption. For a hearing on the proposed
changes to the Regulations, notification shall be published in a newspaper of
general circulation in each county of the State and in a daily newspaper of
general circulation throughout the State. Such notification shall include (1) a
brief description of the proposed changes to the Regulations, (2) the time and
place of the hearing, and (3) the time and place where copies of the proposed
changes may be examined and obtained. Such notice shall also be sent to any
person who has requested notification from the Department by providing their
name and mailing address.
9.2 Decision
9.2.1 Following the public hearing, the
Secretary may adopt, with or without modifications, the proposed changes to the
Regulations. This adoption shall be a final order for purposes of Section 7.0
of the Regulations.
