1.1 Governing statute. Chapter 39 of Title 24 of the Delaware Code governs the Board of Social Work Examiners ("Board") and the professions under its purview.

1.2 Authority

1.2.1 Pursuant to 24 Del.C. § 3906(a)(1), the Board is authorized and hereby adopts these rules and regulations.

1.2.2 Pursuant to the Administrative Procedure Act, 29 Del.C. Ch. 101, the Board reserves the right to make amendments, modifications or additions to these rules and regulations.

1.2.3 The Board reserves the right to grant exceptions to the requirements of the rules and regulations upon a showing of good cause by the party requesting such exception, provided such exception is not inconsistent with the requirements of 24 Del.C. Ch. 39.

1.3 Elections. Officers shall be elected in September of each year, for a one year term. Special elections to fill vacancies shall be held upon notice and shall be only for the balance of the original term.

1.4 Officers have the following responsibilities:

1.4.1 The President will preside at all meetings and sign official documents on behalf of the Board.

1.4.2 The Vice-President will perform the duties of the President when the latter is unavailable or unable to perform the duties of the President.

1.4.3 The Secretary will preside over meetings in the absence of the President and Vice-President.

1.6 Definitions. The following words and terms, when used in this regulation, have the following meaning unless the context clearly indicates otherwise:

1.6.1 "LBSW" means licensed baccalaureate social worker or licensed bachelors social worker.

1.6.2 "LCSW" means licensed clinical social worker.

1.6.3 "LMSW" means licensed masters social worker.
