Section 3300-2.0 - Animals Held in Shelter

2.1 Nothwithstanding the provisions set forth in the Board's Practice Act, Chapter 33 of Title 24 of the Delaware Code, and the Board's Rules and Regulations, the care and euthanasia of animals held in shelter is governed by Chapter 30F of Title 16 of the Delaware Code and the regulations promulgated thereunder, 16DE Admin. Code4501.

2.2 Euthanasia (16Del.C.§ 3004F(a)(4); 16DE Admin. Code4501, Section 10.0)

2.2.1 Notwithstanding Section 1.0 of the Board's Rules and Regulations, specifically subsections 1.2.11 and 1.3.10, euthanasia of animals held in shelter shall be performed by:
2.2.1.1 A licensed veterinarian;

2.2.1.2 A nationally certified euthanasia technician;

2.2.1.3 A licensed veterinary technician; or

2.2.1.4 A person certified by a licensed veterinarian as proficient to perform euthanasia (a certified euthanasia technician), after completion of the requirements in16DE Admin. Code4501, Section 3.0.

2.2.2 A certified euthanasia technician is only permitted to perform euthanasia on shelter animals within the animal shelter of which they are employed,

2.2.3 No one other than the shelter veterinarian or consulting veterinarian may perform euthanasia on privately owned animals.
