39.1 A licensee shall ensure the number of children at the center does not exceed the licensed capacity.
39.2 A child may only attend the center when the information listed in Section 40.0 is obtained from the parent or guardian and placed in the child's on-site confidential file.
39.3 A licensee shall ensure that enrollment procedures involve a meeting with the parent or guardian and the child, when possible, to:
39.3.1 Determine if the center's program can meet the child's developmental and educational needs and determine if any accommodations or other planning is needed to meet the child's individualized needs;
39.3.1.1 Inquire if the child has an IFSP or IEP; and
39.3.1.2 Discuss with a parent or guardian and service providers as applicable, any reasonable accommodations or modifications needed by a child with a disability to access the program or services.
39.3.2 Provide an opportunity for the parent or guardian and child to observe the center and program.
