The provisions of sections 25-8-205 and 25-8-401, C.R.S., provide the specific statutory authority for adoption of the attached regulatory amendments. The Commission also adopted, in compliance with section 24-4-103(4) C.R.S., the following statement of basis and purpose.

BASIS AND PURPOSE

The Commission modified section 65.2 of the regulation to clarify that the discharge of pollutants from any point source to a storm sewer without a discharge permit is prohibited. The Commission found this change to be appropriate to clarify that "point sources" are not limited to certain types of facilities. The Commission deleted previous section 65.2 as it was redundant of section 65.2 and also revised section 65.2 , now 65.2(2), for consistency with those of section 65.2(1).
