Section 30849 - Youth Appearance and Audio Recording of Hearings

(a) All hearings shall be audio recorded when the youth is present. The youth who is the subject of the hearing, his/her attorney, and with the youth's consent, anyone else eligible to appeal a Juvenile Parole Board Order, shall be permitted to listen to the recording. Recordings shall be retained for a period of 15 months from the date of the hearing.

(b) A youth shall attend all Division of Juvenile Justice facility hearings, with the exception of:

(1) Youth unable to attend due to medical reasons as determined by Division of Juvenile Justice medical staff.

(2) Youth housed at or committed to any non-Division of Juvenile Justice facility.
