(a) (Reserved).
(b) Determinations of material benefit will be based on the following:
(1) A person will be materially benefited by
diagnostic services when the reasons why the person displays delinquent behavior are
unclear and the Department has the necessary resources to provide a diagnostic
evaluation and disposition recommendation to the court, or;
(2) A person will be materially benefited by
treatment services when they meet the standards described in Section
31321 of these
regulations.
