Section 1850.535 - Additional Conditions of the Dispute Resolution Process

(a) Nothing in this Article shall preclude the Department from taking oversight/corrective actions against its plans.

(b) Nothing in this Article shall preclude a beneficiary from utilizing the MHP's beneficiary problem resolution process or any similar process offered by the Medi-Cal managed care plan or to request a fair hearing. When there is a conflict between a fair hearing decision and a decision by the Department under this Article, the fair hearing decision shall take precedence.
