Section 1850.520 - Department's Decision

(a) The Director of the Department or his/her designee(s) shall issue a written decision to the MHP and the Medi-Cal Managed Care Plan within 30 calendar days:

(1) From the receipt of the documentation requested from the other party, or

(2) From the twenty-first calendar day after the request for documentation, whichever is earlier.

(b) The written decision of the Department shall include a statement of the reasons for the decision, the determination of rates of payment if the rates of payment were disputed, and any decision and any actions required by the MHP and the Medi-Cal Managed Care Plan to implement the decision.

(c) The Department shall take any necessary steps to enforce the decision, including the withholding of funds to meet any financial liability established pursuant to Section 1850.530.
