Section 10528 - Petition for Increased Compensation - Discrimination Under Labor Code Section 132a

Any person seeking to initiate proceedings under Labor Code section 132 a other than prosecution for misdemeanor must file a petition setting forth specifically and in detail the nature of each violation alleged, facts relied upon and the relief sought. Each alleged violation must be separately pleaded.

The Workers' Compensation Appeals Board may refer, or any worker may complain of, suspected violations of the criminal misdemeanor provisions of Labor Code section 132 a to the Division of Labor Standards Enforcement or directly to the Office of the Public Prosecutor.
